Terms of Service

1. Contractual Agreement

These Terms of Service form part of a contract between FinCEN Report Company (FRC), a Georgia limited liability company, and any individual (User) who creates an account through any website operated by FRC related to residential real estate reporting.

The Services assist Users in organizing, preparing, and filing reports required under the Financial Crimes Enforcement Network’s Residential Real Estate Rule (31 C.F.R. § 1010.380).

2. User Roles and Responsibilities

Users agree to the duties associated with their chosen Role:

  • Buyer Representative: Submitting information on behalf of a buyer.
  • Seller Representative: Submitting information on behalf of a seller.
  • Closing Agent: Facilitating the closing and submitting required reports.
  • Billing Contact: Responsible for payment of fees.
  • Partner Advisor / Administrator: Users designated by Partner Organizations with dashboard access.

Each individual User must maintain a separate Individual Account.

3. User Representations

By using the Services, the User warrants that they:

  • Are of legal age and capacity.
  • Provide true, accurate, and complete information.
  • Will maintain login confidentiality.
  • Will use the Services only for lawful real estate reporting purposes.

Providing false or misleading information may be subject to civil or criminal penalties.

4. Fees and Subscriptions

  • Use of Services may require a subscription or fee.
  • All fees are non-refundable once paid.
  • Billing Contacts agree to timely pay all charges; late payments may incur interest.

5. Disclaimers and Limitations

FRC provides the Services on an “AS IS” basis. While FRC assists with report preparation, it does not provide legal advice or guarantee regulatory compliance.

FRC’s total liability is limited to the fees paid by the User in the preceding 12 months. FRC is not liable for indirect, incidental, or consequential damages.

6. Intellectual Property

All intellectual property in the RRE Site remains the exclusive property of FRC. Users are granted a limited license for use but may not reverse engineer or decompile the software.

7. Privacy and Confidentiality

FRC will maintain the confidentiality of personal and transaction information. Credit card and bank details will be kept confidential and used only for fee collection.

8. Governing Law and Arbitration

  • Jurisdiction: The laws of the State of Georgia govern this agreement.
  • Arbitration: Disputes must be submitted to mandatory arbitration in Fulton County, Georgia, under AAA rules.
  • Time Limit: Any legal action must be brought within one year after the cause of action arises.
